Cakumi Terms of Service

Welcome to Cakumi products and services! This agreement is entered into by Cakumi and you. You should read and comply with the "Terms of Service" (hereinafter referred to as "this Agreement") published on this platform. Using this service indicates that you confirm the content of this agreement electronically and agree to be bound by this agreement. If you or your guardian do not agree to any content of this agreement, you should immediately stop using Cakumi services. If you use this service without the consent of your guardian, you and your guardian shall bear all consequences arising therefrom in accordance with law.

We specially remind you to carefully read (minors under 18 years old should read with legal guardians), fully understand all terms of this agreement before using this service, especially the disclaimer, legal jurisdiction and applicable provisions shown in bold. If you do not agree to any terms of this agreement, it will result in us being unable to provide you with complete products and services, and you can choose to stop using this service. If you independently choose to agree to this agreement, or your registration, login, use and other behaviors will be deemed as your acceptance of this agreement, and you are deemed to accept and comply with the terms of this agreement. In addition to the above terms of service, we have also published a privacy policy that describes how we process, collect, use and protect your information.

The output content of this service is for your reference only, does not represent the attitude or viewpoint of the service provider, and does not constitute any advice or commitment. For situations that may have a significant impact on you or related parties (such as medical, legal, investment and other professional consultations), it is recommended that you consult relevant professionals.

You should scientifically and rationally understand and use this service in accordance with law. Article 1 Definitions

1.1 User

Refers to all natural persons who use Cakumi services through the cakumi.ai website. In this agreement, it can be referred to as "user" or "you".

1.2 Input

Refers to the text input made by the user in the dialog box to use this service.

1.3 Output

Refers to the text, tables, codes, pictures and other content output by this service according to user input.

Article 2 Service Introduction

2.1 Cakumi provides users with remote interface calls and multi-platform integrated artificial intelligence Q&A services according to these terms. Users need to input text information in the dialog box. Cakumi will output corresponding content and selected platform models as responses based on user input, including text, tables, codes, pictures, etc. For your private conversation data, without your explicit authorization, we will not mix your private emotional interaction data into the basic training corpus of general large models.

2.2 The specific functions of this service will be continuously iteratively updated with user feedback, technology upgrades and updates from partners, or changes in relevant regulatory policies.

2.3 When you use a specific function of this service, there may be separate agreements, relevant business rules, etc. for that specific function. Please read and agree to the relevant specific agreements before using that specific function. If there is a conflict between this agreement and the specific agreement, the provisions of the specific agreement shall prevail.

2.4 Service Modification and Upgrade

Due to the rapid development of the Internet industry, the terms of this agreement signed between you and this platform cannot completely list and cover all rights and obligations between you and Cakumi, and the existing agreements cannot guarantee complete compliance with future development needs. Therefore, the relevant statements and policies announced on the Cakumi website, and Cakumi-related rules and agreements are all supplementary agreements to this agreement, which are inseparable from this agreement and have the same legal effect. Cakumi has the right to send you notices of Cakumi website page revisions, service upgrades, service revisions, etc. through announcements (including but not limited to website homepage announcements, system messages, webpage pop-ups), SMS reminders, etc. If you refuse to accept the above changes, please stop using the relevant services immediately. Your use behavior is deemed as your consent to Cakumi website related service modifications and upgrades.

Article 3 Account Login

3.1 Platform services are only provided to registered users. If you need to use Cakumi services, please first complete all registration procedures to become a registered user according to the terms of this agreement and other service rules (including but not limited to "Privacy Policy", "Terms of Service", "Cakumi Children's Personal Information Protection Rules", etc.) and according to the prompts on the page, and ensure that the registration information you submit, including but not limited to name, mobile phone number, contact address, ID number, etc., is true, legal, complete and valid.

3.2 This service is primarily for adults. If you are under 18 years old, please read this agreement with your legal guardian and use this service with the consent of your legal guardian. We fully understand the importance of protecting minors and will take corresponding protective measures in accordance with legal and regulatory requirements and mainstream industry practices. At the same time, please ask guardians to reasonably guide and restrict the use of this service by minor users, jointly create a good network environment, help minors develop good Internet habits, and avoid excessive dependence or addiction to this service.

3.3 In order to implement the national legal and regulatory requirements on real-name authentication, to enable you to better use Cakumi products and related services, and to ensure the security of your account, you need to provide us with a real mobile phone number when registering. In addition, in order to provide you with some functions that are already available or will be launched in the future, we may also strictly collect other personal information from you in accordance with legal and regulatory requirements.

3.4 You understand and promise that the account you set up shall not violate relevant national laws and regulations. Your account name, avatar, profile and other registration information and other personal information shall not contain illegal and adverse information. Without the permission of others, you shall not open an account in the name of others (including but not limited to impersonating others' names, names, trade names, avatars and other methods that are sufficient to cause confusion), and shall not maliciously register accounts (including but not limited to frequent registration, batch registration of accounts, etc.). You need to comply with relevant laws and regulations during account registration and use, and shall not commit any acts that infringe on national interests, damage the legitimate rights and interests of other citizens, or are harmful to social morality. Cakumi has the right to review the information you submit.

3.6 You should keep your account information (including account, password, verification code, etc.) properly. Losses and consequences caused by your improper custody of account information, active disclosure, or attacks or fraud by others shall be borne by you. If you find any unauthorized use of your account to log in to this service or other situations that may cause your account to be stolen or lost, it is recommended that you immediately notify Cakumi. You understand that Cakumi needs reasonable time to take action on your request. Except for Cakumi's objective fault, Cakumi is not responsible for the consequences that have occurred before taking action.

3.8 If you find that your account has security issues, please contact us immediately for investigation and processing, otherwise we will not be responsible for any potential losses or expansion. We especially remind you that you should properly keep your account and password. When you finish using Cakumi platform services, you should exit safely. In addition, you should not easily believe network information involving loans, password requests or other property. For property operations, please be sure to verify the identity of the other party first, and please pay attention to our tips on preventing fraud and crime. You know and agree that if you are at fault in the custody of account information and the network security maintenance of relevant Internet equipment, resulting in account loss or leakage, you shall be responsible for any consequences arising therefrom. We shall not be liable for this. If we incur related expenses as a result, we will have the right to claim compensation from you.

3.9 You know and agree that in accordance with laws and regulations or at the request of state authorities, we have the right to restrict or freeze your registered account. In such cases, you may not be able to continue to log in or use your registered account.

3.10 You can cancel your account and terminate your service relationship with Cakumi at any time, but please understand that even if your account has been cancelled, you still need to bear corresponding legal responsibilities for your account use behavior before cancellation. In particular, before you cancel your account, you should ensure that the account does not have any unfinished transactions or other unresolved rights and obligations, and there are no other situations that may cause disputes due to cancellation or make disputes that have occurred difficult to resolve, including but not limited to your account being frozen or restricted, your cancellation is for the purpose of evading investigation and evidence collection, etc. Please note that if we find that you have illegal behavior during the use of this service, we will preserve such records in accordance with law.

Article 4 Service Usage Specifications

4.1 Based on your use of this service, Cakumi grants you a personal, revocable based on legal or contractual reasons, non-transferable, non-exclusive and non-commercial right to use this service for content input and content output. All other rights not expressly authorized by this agreement are still reserved by Cakumi. You must obtain written permission from Cakumi separately before exercising these rights. At the same time, Cakumi's failure to exercise any of the aforementioned rights does not constitute a waiver of such rights. If you publish or disseminate the output generated by this service externally, you should:

4.2 When using the above services provided by Cakumi, users should abide by this agreement, follow the principles of voluntariness, equality, fairness and good faith, not use this service to infringe on the legitimate rights and interests of others and seek improper benefits, and not disrupt the normal order of Internet platforms.

4.3 To fulfill legal compliance requirements, Cakumi has the right to use automated technical means (such as algorithm filtering, keyword blocking) to review content for compliance. We promise to strictly limit the intervention scenarios of manual review. Only when the system triggers extreme security warnings (such as child pornography, terrorism, suicide intervention and other major risks) and must be manually reviewed, security personnel who have undergone strict privacy training can intervene, and the intervention process will be subject to strict auditing.

4.4 Cakumi reminds you that as a user of this service, you should actively undertake information security obligations when using the above services. You promise not to take the following actions on this service:

4.4.1 Using Cakumi software and services to produce, publish, induce generation, copy, transmit, disseminate, and store prohibited information as specified by laws and regulations.

4.4.2 Through input, inducing the generation of unfriendly conversation outputs, including but not limited to personal attacks, discrimination, harassment, or content harmful to minors.

4.4.3 Through input, maliciously confronting the filtering mechanism of this service.

4.4.4 Interfering with the normal operation of this service and damaging Cakumi's legitimate rights and interests.

4.4.5 Unauthorized copying and use of copyrighted materials.

4.4.6 Other behaviors that violate laws and regulations and infringe on the legitimate rights and interests of third parties and Cakumi.

Article 5 Intellectual Property Rights and Other Rights

5.1 Cakumi is the development and operation entity of this service, and enjoys all rights within the scope permitted by laws and regulations over all data, information, output, etc. generated during the development and operation of this service, except for rights that relevant rights holders should enjoy in accordance with law.

5.2 Unless otherwise specifically stated, the relevant copyrights, patent rights and other intellectual property rights that Cakumi relies on when providing this service all belong to Cakumi, except for rights that relevant rights holders should enjoy in accordance with law.

5.3 You understand and promise that your input when using this service does not infringe on anyone's intellectual property rights, portrait rights, reputation rights, honor rights, name rights, privacy rights, personal information rights and other legitimate rights and interests, and does not involve any state secrets, trade secrets, important data or other data that may adversely affect national security or public interests, otherwise the infringement risks and responsibilities arising therefrom shall be borne by you.

5.4 You know, understand and agree that if you have rights over your input and/or output in accordance with law, your use of this service will not cause the transfer or reduction of the aforementioned legitimate rights, unless we have another agreement with you. At the same time, you understand and agree that Cakumi will store and use the content you upload and publish within the scope permitted by law to achieve the purpose of this service.

5.5 You understand and agree that the content you enter and/or generate, publish, upload, submit, and store when using Cakumi services is either original or legally authorized by you. The intellectual property rights of any content you enter and/or generate through the Cakumi platform belong to you or the original copyright owner.

Article 6 Personal Information Protection

6.1 Cakumi attaches great importance to the protection of users' personal information. Cakumi will collect, use, store and share your personal information in accordance with the provisions of the "Privacy Policy".

Article 7 Service Fees

7.1 Cakumi may charge you fees during the provision of this service. If users use paid items in this service, they should pay relevant fees in accordance with the billing standards and methods announced by Cakumi.

7.2 For functions that are temporarily free, Cakumi has the right to unilaterally change the service content, service period and service standards of temporarily free services according to actual conditions.

7.3 Before the aforementioned modifications, changes or start of charging, Cakumi will notify or announce on the corresponding service page.

Article 8 Breach of Contract Liability and Punishment Measures

8.1 Any consequences caused by users violating relevant laws and regulations or the provisions of this agreement shall be borne independently by the user.

8.2 If the user interferes with the operation of this service or the use of this service by other users in any way, Cakumi has the right to require them to compensate for losses.

8.3 If the user violates the Service Usage Specifications, Cakumi has the right to take warnings, restrict functions, suspend or terminate the provision of services, delete illegal information, lock accounts and other processing measures.

Article 9 Complaint and Appeal Processing

9.1 Complaints. If you believe that this service infringes on your rights, you can send relevant complaint materials to: cakumiiiiiai@gmail.com.

9.2 Appeals. If you believe that we have inappropriately restricted your ability to use this service, you can send relevant appeal materials to: cakumiiiiiai@gmail.com.

9.3 We will provide you with feedback within 15 working days after you submit a complaint or appeal.

Article 10 Disclaimer

10.1 Cakumi is committed to providing safe, stable and continuous services. However, we do not assume other responsibilities except those clearly stipulated by law.

10.2 Due to possible factors such as computer viruses, network communication failures, system maintenance, and possible force majeure events or accidents, Cakumi makes no express or implied warranty for this service.

10.3 Artificial intelligence and machine learning are rapidly developing research fields. Due to technical characteristics, we cannot fully guarantee the legality, authenticity, accuracy and completeness of the output you obtain through this service. You should judge the output yourself and bear all risks arising from using the content.

10.4 The output under this service does not represent professional opinions and cannot replace professionals in professional fields such as law, medicine, and finance. Any judgment you make based on the output content shall be borne by you yourself.

Article 12 Update and Termination of This Agreement

12.1 We have the right to modify this agreement at any time. The updated agreement will be published through appropriate means such as publication on the official website. If you do not accept the modified agreement, please stop using this service immediately. Your continued use of this service will be deemed as your acceptance of the modified agreement.
